These Terms of Service (“Terms”) apply to all users of Rosalind Genetics’ websites (including www.rosalindgenetics.com), services, consultations, and genetic testing (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and the Rosalind Genetics Privacy Policy.
1. About Us
Rosalind Genetics (“we”, “us”, “our”) is a provider of genetic counselling, diagnostic and preventative genetic testing, and associated clinical genetic services in Australia. Our aim is to offer compassionate, expert care, in accordance with health regulation, privacy laws, and clinical best practice.
2. Using Our Services
- You must be of legal age to engage in Services, or have consent from a parent or guardian if you are a minor.
- Where applicable, you must provide complete, accurate, and up-to-date personal and medical information.
- You must follow all instructions we provide, especially in relation to sample collection, counselling, or consultations. Failure to comply may result in delay, inability to perform the test, or invalid results.
- Use of telehealth services is subject to regulatory requirements, and may not be appropriate in all situations.
3. Types of Genetic Services & Testing
Rosalind Genetics provides various genetic services including but not limited to:
- Preconception & Prenatal Genetics
- Carrier Screening
- Paediatric Genetics
- Familial Cancer
- Nephrology Genetics
- Neurogenetics
- Cardiac Genetics
- Preventative Health
- General Genetics
Each service includes access to expert genetic counselling. The types of testing and clinical focus will vary depending on your personal or family history, stage of life, or medical need.
When you engage for a specific service, we will explain what testing is involved, the limitations, risks, and benefits. You will never be obliged to undergo any test; informed consent is required for all testing.
4. Sample Collection & Testing Process
- Samples may be collected by cheek swab, blood, saliva, or other suitable biological material, depending on the test.
- For prenatal tests, samples from the pregnant parent and the possible father may be required.
- Testing is performed by laboratories accredited under relevant Australian standards (e.g. NATA).
- Results will be delivered in an estimated timeframe (e.g. 5‑10 business days for many tests), though this may vary depending on the test type and laboratory capacity.
5. Fees, Costs, & Payment
- Fees for services and testing will be provided upfront wherever possible. If you require Medicare rebates or other funding, we will advise whether your case meets the criteria.
- You are responsible for any out‑of‑pocket costs not covered by Medicare or other health rebates.
- Payment is due prior to processing of tests or services unless alternative arrangements are agreed.
6. Privacy & Use of Your Data
- We will collect, use, store, and share personal and health information consistent with Australian privacy laws (including the Privacy Act 1988) and the Health Privacy Principles in your state or territory.
- Genetic data and test results are sensitive. They will only be shared with authorised personnel, your nominated health professionals, and laboratories as necessary for testing.
- You have rights to access your information, correct inaccuracies, and request its deletion in accordance with the law.
7. Accuracy, Limitations & Disclaimers
- Genetic tests and counselling aim to inform risk and support clinical decisions, but cannot guarantee predictive certainty. A positive result does not necessarily mean you will develop a condition; a negative result does not guarantee absence of risk.
- Some results may be uncertain, or variants of unknown significance. We will explain what these mean for you.
- Information on our Websites or in materials is for general informational purposes, and not a substitute for medical advice. Always consult with your treating clinician.
8. Intellectual Property
- Rosalind Genetics owns (or is licensed to use) all intellectual property in the Services, materials, content, names, logos, and data we provide.
- You are granted a limited, non‑transferable licence to access and use those materials strictly for your personal, non‑commercial use in relation to obtaining services from Rosalind.
9. User Conduct
You agree not to:
- Provide false, misleading or incomplete information;
- Use our Services in any unlawful manner;
- Violate the rights of others, including privacy or intellectual property rights;
- Interfere with the security or proper functioning of our systems;
- Impersonate another person or entity.
10. Cancellation, Refunds & Rescheduling
- Where you wish to cancel or reschedule a consultation or service, please notify us as soon as possible. Specific policies apply depending on the service.
- If you decide not to proceed with a genetic test after being informed and before sample collection, you may be entitled to a refund in accordance with our refund policy.
- Once a sample has been processed or a test has started, refunds may be limited or unavailable for that portion.
11. Liability & Indemnity
- To the extent permitted by law, Rosalind Genetics is not liable for indirect, incidental or consequential loss or damage arising from the use of our services.
- You agree to indemnify us against any third‑party claims arising from your breach of these Terms, or your misuse of the services.
12. Termination of Services
- We reserve the right to refuse, suspend or terminate services at our discretion, particularly if you breach these Terms, provide false information, or pose safety or regulatory concerns.
- Provisions that by their nature survive termination (privacy, confidentiality, liability, etc.) will remain in effect.
13. Governing Law & Disputes
- These Terms are governed by the laws of the State of Victoria, Australia.
- Any dispute arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts in Victoria.
- We may require mediation or other alternative dispute resolution before legal action, where practicable.
14. Changes to Terms
We may update or revise these Terms from time to time. If we do, we will publish the updated version on our website with a new “last updated” date. Continued use of our Services after changes means you accept the new Terms.
